Terms of Service

Article 1 (Definitions)

1. "User" means a person who has registered an account for the Service.
2. "Original Post" means a post or video on Instagram, TikTok, YouTube, X or any other website whose URL a User has saved to the Service.
3. "Card" means a record of a drill on the Service consisting of the URL of an Original Post, notes entered by the User, and text generated by AI Analysis.
4. "Menu" means a plan for a single practice session that a User creates by arranging Cards.
5. "AI Analysis" means the feature by which AI generates the text of a Card based on the publicly available information of an Original Post (limited to YouTube videos and TikTok captions), the notes entered by the User, and images or videos taken by the User themselves. The content of Instagram and X posts is not used for AI Analysis.

Article 2 (Accounts)

1. Users shall register accurate information and shall manage their email address and password at their own responsibility. Users must not disclose, lend or share them with any third party.
2. When registered information changes, Users shall promptly update it on the Service.
3. The Service is intended for persons engaged in coaching sports or other physical activities (including those who assist with coaching).
4. An account may be used only by the person who registered it and must not be transferred to or used by any third party.
5. Users may delete their account at any time from the settings screen. Cards, Menus and ratings of a deleted account cannot be restored.

Article 3 (How the Service Works and Handling of Original Posts)

1. The Service stores the URL of the Original Post, information about the post made public by each service (title, poster name and URL of the thumbnail image), notes entered by the User, and text generated by AI Analysis. We do not copy or store the video files or image files of Original Posts themselves on our servers.
2. Original Posts are played and displayed on the Service through the official embedding features provided by each service, and video and image data are sent directly from each service's servers to the User's device. We do not transmit or distribute Original Posts.
3. If an Original Post is deleted, made private or no longer allowed to be embedded, it can no longer be played or displayed on the Service. We do not guarantee that Original Posts can be played and have no obligation to restore them.
4. When a User uploads images or videos they have taken themselves for AI Analysis, we retain them temporarily only for the analysis and delete them after the analysis is complete. We do not store them or distribute them to other Users.
5. The Service handles Original Posts in accordance with the terms of service and developer terms of each service. Some features of the Service may become unavailable due to changes in the terms or specifications of each service.
6. When a User moves from the Service to another service or external website, the terms of use and privacy policy of the destination apply. We are not responsible for the content of external websites.

Article 4 (AI Analysis)

1. Results of AI Analysis may not accurately reflect the content of the Original Post. Users shall check the generated text themselves and correct it as necessary before use.
2. Safety notes added by AI Analysis are for reference only and do not guarantee the safety of any drill.
3. There is a daily limit on the number of times AI Analysis can be used. We set the limit and may change it.

Article 5 (Prohibited Conduct)

In using the Service, Users must not engage in any of the following conduct:

1. Saving to the Service, or causing to be displayed to other Users, the URL of a video or image uploaded without the permission of the copyright holder or other rights holder (so-called illegal uploads), such as recordings of TV broadcasts, paid video teaching materials, or unauthorized reposts of other people's videos.
2. Uploading for AI Analysis any image or video not taken by the User themselves (such as a screen recording or screenshot of another person's post).
3. Infringing the copyright, moral rights, portrait rights, privacy or other rights of the poster of an Original Post or any other third party.
4. Using Original Posts in a manner that violates the terms of service of each service.
5. Using the content of an Original Post after deleting or altering the poster name, the link to the Original Post or any other attribution displayed on the Service.
6. Displaying content unrelated to drills, spam, advertisements, obscene content, discriminatory content or any other content contrary to public order and morals in public Menus or any other place viewable by other Users.
7. Defaming, threatening or harassing other Users, posters of Original Posts or other third parties, or persons involved in operating the Service.
8. Analyzing or modifying the programs of the Service, or accessing the Service or collecting information on the Service by scraping or other automated means.
9. Using for commercial purposes outside the Service, or redistributing, any information on the Service (including public Cards and public Menus) without the permission of us or the rights holder.
10. Unauthorized access, circumventing access restrictions or other security mechanisms, transmitting computer viruses or other harmful programs, or placing an excessive load on the Service's servers.
11. Impersonating other Users or third parties.
12. Interfering with the operation of the Service.
13. Violating laws or regulations, and assisting or encouraging any of the conduct listed above.

Article 6 (Public Cards and Public Menus)

1. When a User makes a Card "public", the content of the Card (name, summary, steps, rules, coaching points, equipment and reference to the Original Post) is displayed to other Users, and other Users may save it as their own Card. The list of public Cards (name, summary, poster name, reference to the Original Post and, for YouTube videos, the thumbnail image) is also displayed to viewers who are not logged in. Notes entered by the User, tags and rating comments are not displayed. A User who makes a Card public shall confirm that its text is written in their own words and does not copy the caption or other text of the Original Post as is. When several Users make Cards for the same Original Post public, we display one of them in the order we determine.
2. When a User makes a Menu "public", the content of the Menu is displayed to other Users, and other Users may copy it as their own Menu. The list of public Menus (name, names of the included Cards, thumbnail images of YouTube videos, time and equipment) is also displayed to viewers who are not logged in. Users may withdraw publication of Cards and Menus at any time. In public Cards and public Menus, Original Posts other than YouTube videos (such as TikTok, Instagram and X posts) are shown only as a link to the Original Post, without thumbnail images or embedding.
3. We do not guarantee the accuracy, legality or safety of the content of public Cards or public Menus.

Article 7 (Reports and Our Measures)

1. Users may report posts or public Menus on the Service to us using the reporting feature of the Service.
2. Regardless of whether a report has been made, if we determine that these Terms have been or may be violated, we may, without prior notice, hide posts or public Menus, delete Cards, suspend or delete accounts, or take other necessary measures.
3. Requests from rights holders of Original Posts for removal or the like are accepted through the contact point set out in For Rights Holders.
4. We are not liable for any damage incurred by Users as a result of measures under this Article, except in cases of our willful misconduct or gross negligence.

Article 8 (Suspension and Deregistration)

We may, without prior notice, suspend the use of an account or delete the registration if a User falls under any of the following:

1. The User has violated any provision of these Terms.
2. The registered information contains false content.
3. The User has breached the representations and warranties in Article 15 (Exclusion of Antisocial Forces).
4. We otherwise reasonably determine that the User's use of the Service is inappropriate.

Article 9 (Fees)

1. The Service is currently provided free of charge.
2. If we introduce paid features, fees will be for the features of the Service, such as creating and organizing Cards, creating Menus and sharing. We do not charge for viewing Original Posts themselves.
3. If we introduce paid features, we will clearly indicate the fees, payment methods and cancellation conditions in advance.

Article 10 (Intellectual Property Rights)

1. Copyrights and other intellectual property rights relating to the Service belong to us or to persons who have licensed their use to us.
2. Rights relating to Original Posts belong to their posters or other rights holders. The Service does not transfer or license any rights relating to Original Posts to Users.
3. Rights relating to notes and other text entered by Users belong to the Users. Users grant us permission to use them to the extent necessary to provide and improve the Service.
4. Users may use the text generated by AI Analysis within the scope of the purposes of the Service, provided that it must not be used in a manner that infringes the rights of the rights holders of Original Posts.

Article 11 (Feedback)

1. We may use opinions, requests and other suggestions submitted by Users ("Feedback") to improve the Service or for other purposes, without paying any consideration to the Users.
2. We are not obliged to respond to or adopt any Feedback.

Article 12 (Disclaimer)

1. We do not guarantee that the Service will fit any particular purpose of Users, have the functions they expect, operate without interruption or be free of errors.
2. Drills shall be conducted at the discretion and responsibility of the coach who is the User. We are not liable for accidents, injuries or other damage arising from drills conducted based on the content of Cards or Menus.
3. We are not liable for problems caused by Original Posts, other services, or Users' devices or network environments.
4. Even if we are liable to a User for damages, except in cases of our willful misconduct or gross negligence, our liability is limited to direct and ordinary damages, up to the amount of fees paid by the User to us in the most recent 12 months (zero yen if the Service is free).
5. The Service may include advertisements from businesses other than us ("Advertisers") and referral links to websites that sell products ("Referral Links"). Advertisements and Referral Links are labeled "PR", and advertisements also show the Advertiser's name. Cards and Menus published by our official account that were supervised by an Advertiser are labeled as such. We may receive a fee from the operator of a sales website according to purchases made through Referral Links. Purchases of products or services shown in advertisements or Referral Links, transactions with Advertisers or on sales websites and the use of coupons take place between the User and the Advertiser or the operator of the sales website, and we are not responsible for them except in cases of our willful misconduct or gross negligence.

Article 13 (Changes, Suspension and Termination of the Service)

1. We may change the content of the Service, or suspend or terminate its provision, without prior notice to Users.
2. We may temporarily suspend all or part of the Service due to equipment maintenance, failures, natural disasters, suspension of the services of external providers we use, or other reasons.
3. When we terminate the provision of the Service, we will endeavor to notify Users a reasonable period in advance.

Article 14 (Handling of Personal Information)

We handle Users' personal information in accordance with the Privacy Policy.

Article 15 (Exclusion of Antisocial Forces)

1. Users represent and warrant that they do not, and will not in the future, fall under organized crime groups, members of organized crime groups or other antisocial forces, and that they have no relationship with such persons.
2. If a User breaches the preceding paragraph, we may suspend the use of the account or delete the registration without prior notice.

Article 16 (Changes to These Terms)

1. We may change these Terms if the change conforms to the general interests of Users, or if the change is reasonable in light of the necessity of the change, the appropriateness of the changed content and other circumstances.
2. When we change these Terms, we will make the changed content and its effective date known by displaying them on the Service by the effective date.

Article 17 (Contact and Notices)

1. Notices from us to Users are given by display on the Service or by email to the registered email address.
2. Inquiries about the Service are accepted at support@plaxapp.com.

Article 18 (Governing Law and Jurisdiction)

1. These Terms are governed by the laws of Japan.
2. Any dispute between us and a User concerning the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
